    BAMF provides business automation and marketing flywheel services, including CRM architecture and configuration, marketing automation systems, custom workflow development, AI agent deployment, and related consulting services. Specific service deliverables, timelines, and pricing are documented in individual client engagement agreements.

    4. SMS and Text Messaging Terms

    The following terms apply to SMS communications between BAMF and recipients who have provided opt-in consent.

    OPT-IN

    SMS messages are sent only to recipients who have provided affirmative consent through a documented opt-in method, including completing a website form with the SMS consent checkbox affirmatively checked, providing verbal consent during a recorded call, or completing a written consent form.

    OPT-OUT

    You may opt out of receiving SMS messages from BAMF at any time by replying STOP to any text message. You will receive a single confirmation message acknowledging the opt-out, after which no further SMS messages will be sent. Opt-out is processed immediately and applies to the specific consent category from which you opted out (marketing or non-marketing).

    MESSAGE FREQUENCY

    Marketing message frequency varies but typically does not exceed four messages per month per recipient. Non-marketing transactional messages are sent only in response to specific actions (such as form submissions, appointment confirmations, or support inquiries) and frequency varies based on your interactions with BAMF.

    CARRIER LIABILITY

    Message and data rates may apply based on your mobile carrier plan. BAMF is not responsible for delays, failures, or non-delivery of SMS messages caused by your mobile carrier, network conditions, or device limitations. Carriers are not liable for delayed or undelivered messages.

    SUPPORTED CARRIERS

    BAMF's SMS service is delivered through licensed carrier infrastructure including AT&T, Verizon, T-Mobile, and other major U.S. carriers.

    5. Acceptable Use

    You agree not to use our website or services to:

    • Violate any applicable law or regulation.
    • Infringe on the intellectual property rights of others.
    • Transmit harmful, threatening, defamatory, obscene, or otherwise objectionable content.
    • Attempt to gain unauthorized access to our systems or networks.
    • Interfere with the operation of our website or services.
    • Use our website or services to send unsolicited communications to others.
    • Impersonate any person or entity.
    • Collect personal information about others without their consent.

In the event of any conflict between these Terms and a signed engagement agreement, the engagement agreement controls.

    Payment terms for client engagements are specified in each engagement agreement. Late payments may incur fees as documented in the engagement agreement.

    9. Disclaimers

    Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

    BAMF does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Use of the website is at your own risk.

    10. Limitation of Liability

    To the maximum extent permitted by law, BAMF Development Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, including but not limited to loss of profits, data, business interruption, or goodwill, even if BAMF has been advised of the possibility of such damages.
